1: Sale and Purchase.
1.1 The sale, by us or the purchase by you of items is subject to the terms and conditions outlined below. These conditions apply to the exclusion of all other terms & conditions unless accepted in writing by Cleveleys Nursery.
2: Description of Goods.

2.1 Every effort has been made to ensure that both the pictures and product descriptions accurately represent the products that you will receive, however Cleveleys Nursery cannot guarantee that slight variations will not occur.

3: Price.

3.1 All prices quoted on this site are in pounds Sterling.
3.2 Prices are subject to change at any time, and we reserve the right to vary any price at any given time on this site without prior notice.
3.3 Postage & Delivery.
Carriage charges are correct for UK mainland only. Cleveleys Nursery have the right to change these, subject to fuel surcharges etc, without prior notice. UK offshore and overseas rates are additional to those calculated and are available on request.
4: Payment.

4.1 Payment must be made by using Pay Pal and in Pounds Sterling only. 

5: Ownership of Goods.

5.1 Any product will remain the property of Cleveleys Nursery until full payment has been received by us, and has been cleared by our bankers.

6: Passing of Risk.

6.1 The risk in the products will pass to you on delivery, as set out in paragraph 7.3 below.

7: Delivery.

7.1 Subject to availability, we will endeavour to despatch goods within 48 hrs from receipt of full payment. Heavy items might take longer to deliver. Any dates specified by Cleveleys Nursery are intended to be an estimate. We cannot be held responsible for delays in the delivery caused by our suppliers, or any other third party.

7.2 All products are sent by our preferred carrier at time of despatch.
7.3 You bear the risk once the products have been signed for/received.
8: Non Delivery.
8.1 Any liability of Cleveleys Nursery for non-delivery of the Products shall be limited to replacing the product within a reasonable time or issuing a credit note to the value of goods excluding any handling and packing charge.

9: Acceptance.

9.1 The customer shall inspect the goods immediately upon delivery and shall within 7 days of such delivery give notice in writing to the Company if it is alleged that the goods are not in accordance with the contract.  Unless you notify us in writing of any fault, we will consider the products being as described, of satisfactory quality and fit for their purpose, and may not accept any rejection or cancellation at a later date. Your statutory customer rights are not affected.

10: Faulty Goods.

10.1 Please email or call us to discuss any issues relating to faulty products. It will be at our discretion if the goods are to be replaced or exchanged. We will endeavour to meet our obligations and instruct you accordingly of the outcome and how to return if necessary.

11: Returns.

11.1 Any claims made outside of the 7-day period will not be accepted. Items being returned must be returned accompanied by the original purchase receipt, be in their original packaging and unopened, unless faulty. Customer returns are processed within two weeks of our receipt and are subject to the terms and conditions outlined above. Any items returned (excluding  Faulty items) will be at the discretion of Cleveleys Nursery and incur a 10% (Purchase Price) re-stocking fee.
11.2 IMPORTANT NOTE: This facility is available for unused goods only. If you return goods back to our service centre in used condition we cannot process them and clearly no refund will be provided. Items are returned at your own expense & risk and must arrive in perfect and unused condition for the refund to be issued.
12: Guarantee.
12.1 Where Cleveleys Nursery is not the manufacturer of the Products, Cleveleys Nursery shall endeavour to transfer to you the benefit of any warranty or guarantee given to Cleveleys Nursery ("the Warranty") by the manufacturer. Generally all items are covered by a standard 6 months manufacturing warranty. This warranty covers manufacturing faults only. Any damage caused by incorrect use of the product or general wear and tear will not be covered. This is at the discretion of Cleveleys Nursery Agency and does not affect your statutory rights.
